when you are the biological father, it isn't automatic that the child - in event of mother's death - goes to the father's custody...
Right, we all know that... but shouldn't the starting point be who is the biological father of the child?
In the custody of the child, the best interests of the child are the focus.
Duh, yes and that's exactly why Howard K. Sterns "enabling," of Smith's drug habits, as Judge Seidlin stated, his assistance at the hostpital when Smith was in the mid-term of her pregnancy to supplement her with drugs, according to the testimony of Larry Birkhead, and that videotape Stern took of Smith painted up like a clown will be central to determination of whether or not Stern would have the best interests of the child.
What kind of father - named as such on the child Dannielynn's birth certificate - as shown in the videotape allows a minor child to be present face-painting when noting the mother-to-be looks like she is having a mushroom trip?
Furthermore, Anna Nicole Smith according to Larry Birkhead kept a Baby Book in the hospital wherein she had Birkhead, and Stern put in their thumbprints.

Larry Birkhead, Anna Nicole Smith's former boyfriend who claims to be the father of her 5-month-old daughter Dannielynn, took the stand on Wednesday during the ongoing hearing to decide who will get custody of Smith's remains.
The Los Angeles-based photographer testified that Smith told him they were having a baby together – and he also claims to have witnessed Smith's attorney, Howard K. Stern, giving drugs to the former Playmate while she was hospitalized.
According to Birkhead, he and Smith lived together from August 2004 to April 2005 – and in January 2005 Smith told him she was pregnant, but a month later suffered a miscarriage.
Birkhead also described visiting a pregnant Smith in the hospital in April 2006, when, he says, "she was trying to get off medications," and he says he witnessed Stern taking pills out of a duffle bag and giving them to Smith.
"She was taking medication before and during her pregnancy," Birkhead testified. "I was very concerned...We had a couple of clashes in the hospital because she and Mr. Stern brought in a duffle bag...They would take [these drugs] on top of the drugs they gave her at the hospital."
On another occasion during Smith's stay in the hospital, she had Birkhead put his thumbprint in a baby book that listed him as the father. Birkhead said he "felt sorry for Mr. Stern," who also claims to be the baby's father.
According to Birkhead, Smith added Stern's name the baby book, as "Uncle Howard."

Two men claiming to be the father of Anna Nicole Smith's baby squared off in court Wednesday and battled over paternity and profiteering...
For the first time, Los Angeles photographer Larry Birkhead testified in open court Wednesday that he was the father of 5-month-old Dannielynn Hope Marshall Stern.
He said that he and Smith, 39, even bought a baby book and put their names and thumbprints in the pages under father and mother. Howard K. Stern, Smith's longtime companion and lawyer, put his thumbprint in the book, too, as "Uncle Howard," Birkhead said.
