There is a major push right now to pass H.B. 550, a bill put forth by Rep. Rush Holt to mandate a paper trail (along with a flimsy audit that no accountant would agree is adequate).

Election reform groups are split on whether they support H.B. 550. Black Box Voting normally does not weigh in on legislation, this time we will. Citizens need to be informed of the dangers as well as the benefits when being urged to support legislation.

Like an antibiotic that's too weak, we believe that H.B. 550 will create a more resistant strain of election infection.

Washington, D.C. – Oversight and Government Reform Committee Ranking Member Tom Davis (R-VA) released the following statement today on a committee report that sheds important new light on Sandy Berger’s theft of classified documents from the National Archives. The report makes it clear that the full extent of Mr. Berger’s document removal can never be known, and consequently the Department of Justice could not assure the 9/11 Commission that it received all responsive documents to which Mr. Berger had access.

“My staff’s investigation reveals that President Clinton’s former National Security Advisor Sandy Berger compromised national security much more than originally disclosed,” Davis said. “It is now also clear that Mr. Berger was willing to go to extraordinary lengths to compromise national security, apparently for his own convenience.

“The 9/11 Commission relied on incomplete and misleading information regarding its access to documents Mr. Berger reviewed. No one ever told the Commission that Mr. Berger had access to original documents that he could have taken without detection.

“We now know that Mr. Berger left stolen highly classified documents at a construction site to avoid detection. We know that Mr. Berger insisted on privacy at times to allow him to conceal documents that he stole. One witness with a very high security clearance believed he saw Berger concealing documents in his socks.

I disagree with this statement: "An auditing mechanism cannot catch nefarious actions. Nefarious software inserted in the DRE will just arrange things so everything written into the audit looks fine." Have you reviewed the end-to-end transaction audit system devised by VoteHere/Dategrity? It is simply not true with such a system for the computer to change anything and have it not be detected. This system is unique. It isn't based on traditional security measures. You can send voter ballots deliberately through nefarious hands and catch any changes that are attempted.

The administration officials counter their critics by saying everything about SPP is on the White House Web site. And they say the partnership is not a treaty, but more of an outline of priorities between the United States, Mexico and Canada. UNIDENTIFIED FEMALE: This SPP includes, for instance, a committee that is sitting down to harmonize our meat inspection and food safety. So, how far away from a trade agreement can your dining room table and what you feed your kids be?

TUCKER: Other parts of the agreement mention border security as an issue, which include all of North America. In fact, the name of the agreement is not Security and Prosperity of the United States, but of North America.

PETER MORICI, PROFESSOR OF INTERNATIONAL BUSINESS, UNIVERSITY OF MARYLAND: When we elect officials, we expect them to act on our behalf. When we get involved in cooperative frameworks with other countries for joint regulation of fisheries or rail transportation or the skies, we're basically sharing our sovereignty with that government and outsourcing some of what we give our elected officials.

TUCKER: As disturbing as some find SPP, there is legislation in the House introduced by Florida's Katherine Harris that closely resembles the goals of the partnership.

DOBBS: Tonight, a proposal for an expanded so-called free trade zone from Alaska to the tip of South America. It's a plan from the business elites, the political elites, that will cost more American jobs, cost more American sovereignty, but it would fulfill the president's father's vision.

Bill Tucker reports.

BILL TUCKER, CNN CORRESPONDENT (voice over): It's not a new idea. President Bush talked about it back in 1991.

GEORGE HERBERT WALKER BUSH, FMR. PRESIDENT OF THE UNITED STATES: It is a big idea, a new world order, where diverse nations are drawn together in common cause.

TUCKER: Now former United States trade investor Robert Zoellick is talking about it again with renewed vigor. This time, a new world order with business at the helm of trade and economic policy. Advocating what he calls the Association of American Free Trade Agreements, a separate nongovernment entity which would include North, Central, and South America.

ROBERT SCOTT. ECONOMIC POLICY INST.: What Zoellick is really proposing here is a stealth trade agenda. It's not a national agenda. He's proposing to set up what is essentially a private organization to try to achieve what he couldn't get done when he was the U.S. trade representative. And this is a business agenda.

TUCKER: It's an agenda that goes hand in hand with the United States, Mexico, and Canada, working quietly and behind the scenes to promote a common market with common deregulation for the benefit of multinational corporations. It's an agenda that so far has resulted in an increase in U.S. corporate profits of 45 percent, while wages of American workers have risen only 3 percent in the last five years.

ALAN TONELSON, U.S. BUSINESS & INDUSTRY COUNCIL: The main danger raised by Zelic's (ph) proposal is that the future of American international economic policy, which affects not only our nation's prosperity but its national security, will be set not by the American people and their elected representatives, but by a small corporate elite is that accountable to no one but itself.

TUCKER: Effectively surrendering the sovereignty of the United States.

TUCKER (on camera): And as justification for trusting those who would have the authority? The argument is made that free trade promotes democracy and the welfare of the people.

But, Lou, one has to look further than China to see whether that, in fact, is true.

DOBBS: You know, talking about Zelic's proposal, it's not Zelic's proposal. It's daddy's proposal. And people better understand that they mean exactly what they're saying. It's a new world order they're trying to create. And they're trying to do so not only without approval or consent of the governing of this country, but despite the popular will. This is a straightforward assault by the elitists in this country.

Fox 'n Friends this morning - catch and release, says Steve Doocey, consternated that law enforcement catches illegal aliens committing crimes, incarcerates them, turns them out and nothing happens. They return to commit more crimes.

The question arises, if illegals are capable of committing crimes such as illegal drug dealing, robberies, murders what is to stop them from taking a chance for big bucks and smuggling in a biological weapon? New York jittery over gas smell.

That has to say the least in the headlines that could be said. They all should be wondering whether this was a trial run for something to occur later.

What if the leaking gas situation was in actuality planned to determine how New Yorkers would react to news of another gas leak.

Few may remember, but the day of September 11, 2001 fire department was called out to a gas leak that morning. The Naudet brothers were filming a documentary of the department and that's how the world has footage of the first, yes the first plane crash into the World Trade Center!

By contrast, Ranger Eggle was shot down by Mexican drug dealers who were using Organ Pipe as a route for their smuggling. Only 28 when he was murdered, Eggle was a valedictorian and an Eagle Scout who joined the National Park Service because he loved the outdoors. (Organ Pipe is considered to be the most dangerous of the national park system: 200,000 illegal aliens and 700,000 pounds of drugs were intercepted at the park in 2001.) The Eggle family is determined that his death will not be forgotten by working for real border control, including a Washington press conference with Tom Tancredo in the fall of 2002. A large fuss is being made about a semi-undisclosed connection between Prof. Avi Rubin of Johns Hopkins, who led the highly critical recent study of Diebold's voting machine security, and VoteHere, a company that has a cryptographic voter verification scheme.

Rubin was on the "technical advisory board" of VoteHere. In the high-tech corporate world, technical advisory boards are groups of experts who provide technical advice to the company. Members usually receive stock options for a small fraction of a percent of the company's equity.

In one of the posts at Net the Truth Online, we published a link to the black Box Voting site that claimed to confirm Robert Gates was a member of board of directors of VoteHere.

We have found through an internet search on another issue that Bev Harris' claim that Robert Gates was a director of Vote Here was challenged on BBV forums by Saul Iversen around November 12, 2006.

Over the course of several posts between her and Saul Iversen, finally, Harris admits:

To date, Harris still has not posted her original documentation for the reference source she says was possibly used for her own claim concerning Gates.

And by the way, look up the former Chairman of the Board at VoteHere: Admiral Bill Owens. He was on the Defense Policy Board and was running SAIC. (Hint: SAIC, involved in a coverup of Diebold flaws, see the BradBlog article on this) You'll see.

By the way, a fledgling company with no sales doesn't just happen to attract the former director of the CIA [Robert Gates] and one of the top people on the Defense Policy Board [Admiral William Owens] and one of the original NASED kingpins [Ralph Munro, who violated state law by accepting a position with VoteHere 10 days after stepping down as Washington Secretary of State without waiting the required 3 years]. Munro, who lists himself as a lobbyist on the VoteHere forms, somehow managed to get himself seated on the Carter-Baker panel to examine voting systems.

Ask yourself what was promised to these heavy hitters to get them involved. The product has never had particularly lucrative prospects, so what was the reason they chose to become part of this tiny company that sold virtually nothing in six years?

Remember that they are a venture-capital backed company, and as such, they publish their members of their board of directors. Since Gates is not listed anywhere in their publication as a member of the board of directors, then either:

A. He was not a member of the board of directors.

B. We can have some fun and get them into some serious trouble. Just think... you can bring them down in a simple action.

Find any reference which actually demonstrates that they are lieing when they still maintain that he has never been on their board of directors (because that's indeed what they maintain -- I have a letter here suggesting as much) and I will hire the legal team to harrass them for it. I'll pay you a bonus finder's fee prize (you name the amount before I commit) as an incentive. Anyone a taker? Anyone care to find the truth? I'll wash your car every month. I'll do your laundry for a year. You name it.

P.S. I still humbly maintain that he was never a member of their board of directors. If he was, then again, they are in for the ride of their life... as they have officially lied.

I hope you understand the extraordinary significance of the difference between being on the board of directors versus being on the board of advisors. It is monumental. They are two completely different things. And that significance weighs heavily in your post here on your web site AND in the similar claims you make in your book. Most entrepreneurial startups have a board of advisors that plays a very distinct role from the directors. Where there is power with a director, there is absolutely none with an advisor. It's a key distinction that financial analysts understand and appreciate.

The citation above that you have posted here amalgamates members of both classes and so does not demonstrate membership in the directors. Gates was in fact an advisor, not a director.

So far, the S.F. Chronicle says he is a director, VoteHere says advisory board, and there are references to court documents that reportedly refer to him as a director. Nothing definitive -- except you say you know that he was NOT a director, and that he WAS an advisory board member, therefore, you must have some level of inside knowledge about this.

I can imagine that the S.F. Chronicle reporter may have misunderstood and called Gates a member of the board of directors when he was actually a member of the advisory board.

You seem very close to the situation, Saul. You know this because...?

And since you seem to have close information on this, I'm interested in your take on the entrapment actions and the "hack" and "stolen source code" situations which Jim Adler specifically says VoteHere traced to voting integrity activists.

And what is your take on the SAIC, a company that Owens (and many reports say Gates) were involved with, doing an analysis of the Diebold programs, finding flaws that the purported solution for would be VoteHere?

Don't you think that's a conflict of interest?

And what's your take on the extraodinarily heavy representation of people who are enamored of the VoteHere solution in the NSF-funded ACCURATE program?

I'm asking you this because you apparently have personal or inside knowledge, since the Internet doesn't currently have any clear record on whether Gates was a director or an advisor, but you have stated that he was an advisor, with certainty.

I know the tone of this may sound aggressive, but please bear in mind that the actions taken against me due to VoteHere were extraordinarily and inappropriately aggressive, and need to be examined more closely before anyone even considers spending taxpayer dollars on VoteHere.

Whether Robert Gates or the advisory board members knew about the entrapment scheme or not I don't know; maybe they did, maybe they didn't, but it should be investigated further.

I don't see it as "huge" as Saul Iverson does. It doesn't even entirely get Robert Gates out of the line of questioning with the entrapment attempt, since the VoteHere Advisory Board members were given stock options. There was a fiduciary interest in discrediting and marginalizing critics, though the entrapment thing was hard to believe in its outright amateurishness and overreaching.

Being on the advisory board of a company that makes a police report claiming theft of code they are giving away, and then persuades law enforcement to harass one of their business critics about it -- hmm, I wouldn't say that's exactly a feather in a cap.

Whether or not it's culpable depends on who knew what and when. In fact, that question is getting more and more interesting. Now we know that SAIC was covering up flaws, and that RABA covered up, and that SAIC had connections with VoteHere while SAIC evaluated Diebold identifying flaws for which VoteHere is the solution.

I'm sorry. It really does stink.

Notice Mr. Fulford that none of these items show a documentary source. Noone in these examples bothered to demonstrate (or apparently conduct) their homework. Actually, in the last example you cite, you also see language written in the first person which suggests that the author is Bev Harris. That would be circular reasoning to use her as a source in this example.

Web queries are wonderful, and the internet is indeed a rich resource, but I personally feel a sense of responsibility in this community to do my own homework. I won't merely accept a reporter's word or an internet query about something for which I know I can obtain first-hand information for myself (based on the company dynamics). As Bev herself has said in her closing for this blog entry, "But that's just me."

Mystery man... that's funny. I find it somewhat scary how easy it is to find out about me by simply executing an unsophisticated internet query. Utterly scary. But I'm an open book. I've also offered up here at BBV my affiliation with TrueVoteMD. There are posters here that know me personally, have regularly met me face to face in our weekly TrueVote meetings (during critical legislative sessions). I am actively involved in their Technical Committee. And I know the founders personally. You can simply call the number on their site TrueVoteMD.org and do a simple background check on me. It's no mystery. You'll quickly see if I have an agenda contrary to the purpose of this site. I spent the past several months supporting one of their founding member's bids for the U.S. Senate. He's also the co-founder of VoteTrustUSA (often on CNN, etc).

I have no affiliation whatsoever with any vendors. Period. I have met with many CEO's of a variety of companies in my quest for knowledge and as a part of my role at TrueVoteMD. But I have no vested interest whatsoever. No conflicts at all. I earn a wage as a geek, an engineer. I'm noone special.

With regard to Dategrity/VoteHere, let me say this. Their CEO and another team member flew out to the east coast, drove up to the private home of a TrueVoteMD member, and sat down with us on a Super Bowl Sunday of all days to field questions about the VHTi technology. They came to us. They were venturing into antagonistic territory to answer questions. That's how I know them. I also met with many of their employees at the local Maryland legislative hearings. And I felt entirely comfortable contacting literally any of them with questions as I reviewed their technology. As I do with any CEO or employee of any company. I'm quite aggressive in my search for the truth.

And I won't be remotely tainted with any appearance of a conflict of interest along the way.

Nice piece about the connections with HAVA, Robert Gates and VoteHere but it appears that you've neglected to connect the rest of the dots.

VoteHere was the original owner of the verifiedvoting URL, which they provided to David Dill for his use. But, the early petition that Dill had posted on his website for signatures used the phrase "voter-verifiable" rather than "voter verified." I had immediately noted to Dill and others) my strong objection to the word "verifiable" but he insisted on using it, and later explained that it was necessary in order to gain acceptance among the cryptographic community (which of course included VoteHere).

All of verifiedvoting's writings and petitions (until fairly recently) have used the word "verifiable" (rather than "verified"), which one can confirm by Googling on "voter-verifiable" (with or without the hyphen). (Note that it is well documented that I, not Dill, originated the phrase "voter verified" though I do permit and encourage the free use of this terminology.

Thankfully most of the state and federal legislation that has been introduced (and passed) with regard to VVPATs, correctly uses the word "verified" rather than "verifiable."

Another connection between the academic election technology community and VoteHere was revealed in 2003 shortly after the Johns Hopkins Diebold report was released. As it turned out, Avi Rubin had failed to "remember" that he was a member of the technical advisory board of VoteHere, and further that he held stock options in the company (during the period when VoteHere was lobbying Congress). ESI's Report on the VVPAT

Earlier this week, the Election Science Institute (ESI) released this report regarding the use of an electronic voting system with a contemporaneous paper record. The focus of the report is the implementation of a Diebold system in Cuyahoga County, Ohio, but the report is essential reading for anyone who's interested in the ongoing debates regarding electronic voting. It's received a fair amount of coverage, including stories in the Columbus Dispatch and Cleveland Plain Dealer, as well as this cogent analysis from Dan Seligson of electionline.org...

So what was the cause of the major problems with the VVPAT records? Was it mechanical problems or inadequate poll worker training? It's hard to answer this question definitively, but I suspect that it's some combination of these and perhaps other factors.

In any event, the ESI findings suggest that there are serious practical problems with the implementation of present-generation VVPAT systems. We simply don't know whether VVPAT systems in other places have the same problems found in Cuyahoga, because no one's done a comparable analysis.

ESI's report certainly provides additional reasons for doubting the assumption that has been a prime motivation for making the VVPAT the official ballot of record -- namely, that paper records are necessarily more accurate than electronic records. The report suggests the potential for very serious problems in states that have passed such laws. Unless the mechanical and/or training issues found in the ESI report are resolved, it is quite likely that reliance on the VVPAT in recounts will lead to the wrong result in some future election.

Ohio report finds challenges abound in evaluating voter-verified paper audit trails

A 240-page report on failures and foibles during Cuyahoga County’s May primary raised more questions about the accuracy and reliability of touch-screen voting machines which researchers say failed to match up electronic ballots to paper versions of the vote.

Perhaps equally significant – and noteworthy – are the details of the considerable woes that plagued the voter-verified paper audit trail (VVPAT) system through careless election administration, printer failures or both.

Buried some 93 pages into the report, which was commissioned by county leaders and produced by the San Francisco-based Election Science Institute, are details of errors that included poll workers loading thermal paper into VVPAT printers backwards, blank audit trails, “accordion-style” crumpling of ballots, long blank spaces between ballots that could have represented missing or unprinted VVPATs, torn and taped-together VVPATs and missing ballot text.

ESI researchers found that nearly 10 percent of VVPAT ballots sampled were in some way compromised, damaged or otherwise uncountable, an alarmingly high proportion for a state that requires that paper be used as the ballot of record in the event of a recount.

That led ESI to the ominous conclusion that “in the event of a recount or election contest, the risk of legal challenges is exceptionally high if no significant modifications are made to the current election system.”

“The VVPAT is only as reliable as the administration of the system that produces the paper trail,” said Tracy Warren, the ESI researcher who led the manual VVPAT recount....

To critics, the high percentage of damaged or uncountable VVPATs damaged rated as significantly worse than ‘imperfect.”

“Ten percent is a complete disaster and totally defeats the purpose of a VVPAT,” said David Dill, a Stanford University computer science professor and founder of Verified Voting. “You can blame it on poll worker training, but there are ways to design equipment that makes user error less likely. There are indications that Diebold has done a less than adequate job in design. The company has adopted a generally reluctant and unenthusiastic stance to paper trails and it shows in the design.”

The answer to VVPAT problems, Dill said, would be precinct-counted optical-scan units.

“There are fewer questions about it,” he said. “We know with appropriate care and poll worker training, we can run a good election on optical scan.”..

Election Science Institute (ESI) of San Francisco California was hired to investigate and report on problems with the May primary election in Cuyahoga County, Ohio. The 240-page report was just released this month (August), and some in the elections community have ignored a large majority of the report and zeroed in on a single aspect that supports their thesis that voters don't need any paper, even when voting on a Direct Recording Electronic (DRE) voting machine.

Daniel Tokaji is an Assistant Professor of Law at the Ohio State University’s Moritz College of Law and the Associate Director of Election Law at Moritz. He has testified against a voter verified paper audit trail (VVPAT) to a US House committee and the Election Assistance Commission..

...I find it interesting that different people on different sides of the issue have used this report to back up the claims they've been making all along. One thing that is absolutely clear to me, and something I believe pretty much everybody would agree on is that such studies are extremely valuable, and we need more of them.

...I will take this opportunity, as I have in the past, to respectfully disagree with Dan Tokaji, although not entirely. I will concede that the machines used in this study clearly did not implement an ideal paper audit trail. In fact, if you read the study, it is pretty clear that there were many faults with the paper audit trail. Where I part ways with Tokaji's is in his conclusions. I do not believe that the concept of a voter verified paper audit trail should be thrown out just because there was a poor implementation of it. In fact, if you consider a ballot marking system, where there is no electronic tally, such a system qualifies as a VVPAT, and would by its nature avoid many of the problems that arose in Cuyahoga County, Ohio...

Despite a last-minute attempt to stop it, the manual recount of more than 23,000 votes cast in a critical Chester County statehouse race begins this morning.

With control of the state House of Representatives at stake, Democrats yesterday filed an appeal in Pennsylvania Commonwealth Court to stop the hand retallying.

The Democrats sought a machine-driven recount, arguing the manual recount could drag out and leave the West Chester area without a state representative when the legislature reconvenes Jan. 2. That would deny voters a voice in determining the next Speaker of the House, they said.

But the appeal was quickly quashed in an order signed by President Judge James Gardner Colins, who addressed the Democrats' concerns by ordering the Department of Voter Services to conduct and complete a hand recount no later than 5 p.m. Dec. 26.

Earlier this week, the head of Voter Services, Linda Cummings, estimated that a machine recount would take at least six days - which Democrats disputed - and that a hand recount would require seven to 10.

Only 23 votes separate Democratic frontrunner Barbara McIlvaine Smith from Republican Shannon Royer, a difference of one-tenth of 1 percent. Whichever candidate wins the 156th district seat will give his or her party a 102-101 edge in the House...

HARRISBURG - A judge Friday granted a request by Republicans for a hand recount of 23,000 ballots in a close legislative election that will determine whether Democrats will reclaim the majority in the state House of Representatives after 12 years.
Chester County Judge Howard F. Riley Jr. said the recount of the 156th District election, in which Democrat Barbara McIlvaine Smith edged out Republican Shannon Royer by 23 votes, would begin on Tuesday and continue "each day thereafter."

The Democrats had sought a machine recount and wanted the ballots to be run through a different model of optical scanning machine than the type that was used in the Nov. 7 general election — a process they said could be completed in just three days.

But the Republicans have said they are concerned about evidence that some ballots may not have been properly scanned, and proposed a hand count that they estimate will take about two weeks.

Democratic lawyer Clifford B. Levine said Friday he was "disappointed" with the order and was reviewing it to determine whether he would appeal to Commonwealth Court on Monday.

Levine said state election law requires ballots tallied by electronic voting systems to be recounted electronically, and that the Republicans were unnecessarily prolonging the process. The House will meet Jan. 2 to swear in new members and elect a speaker.

"They're going to try to delay this election and prevent us from getting a true recount until weeks or even a month away, so that when the House of Representatives meets they will deprive the voters of the 156th District the opportunity to participate in the selection of the speaker," Levine said...

The Republican State Committee is asking the state to investigate reports of voting machine malfunctions yesterday.

As many as 12 counties -- Cumberland, Lebanon and Lancaster among them -- reported problems, according to a letter GOP counsel Lawrence Tabas wrote to Pennsylvania Secretary of State Pedro Cortes. Some people reported that machines were changing Republican votes to Democratic, Tabas said.

The former Immigration and Naturalization Service estimated that as of January 2000 the total unauthorized immigrant population residing in the United States was 7 million. This total includes those who entered the United States illegally and those who entered legally but overstayed their authorized period of stay.

A more recent study estimated that there were about 10 million illegal aliens living in the United States as of March 2005. The study estimated that nearly 700,000 aliens entered the United States illegally or overstayed their authorized period of stay each year between 2000 and 2004. Some experts believe this is a overly conservative figure and that illegal immigrants number close to 20 million.

At the same time, after a steady annual reduction in crime, the annual FBI Uniform Crime Report reveals a slow but sure yearly increase in crime, especially violent crime. Some criminologists attribute the rise in crime to illegal aliens who come into the United States with a criminal background.

Many illegal aliens in the United States have been arrested and incarcerated in federal and state prisons and local jails, adding to already overcrowded prisons and jails. The US Justice Department issued a report on criminal aliens who are incarcerated in federal and state prisons and local jails...

...They were arrested for a total of about 700,000 criminal offenses, averaging about 13 offenses per illegal alien. One arrest incident may include multiple offenses, a fact that explains why there are nearly one and half times more offenses than arrests. Almost all of these illegal aliens were arrested for more than 1 offense. Slightly more than half of the 55,322 illegal aliens had between 2 and 10 offenses.

About 45 percent of all offenses were drug or immigration offenses. About 15 percent were property-related offenses such as burglary, larceny-theft, motor vehicle theft, and property damage. About 12 percent were for violent offenses such as murder, robbery, assault, and sex-related crimes...

Judicial Watch had filed a “motion to compel” with the U.S. District Court for the District of Columbia on May 17 after the Secret Service failed to comply with an April 25 court order to release all official logs detailing the Abramoff visits without redaction. WASHINGTON — The White House and the Secret Service quietly signed an agreement last spring in the midst of the Jack Abramoff lobbying scandal declaring that records identifying visitors to the White House complex are not subject to public disclosure.

The Bush administration didn't reveal the existence of the memorandum of understanding until last fall. The White House is using it to deal with a legal problem on a separate front, a ruling by a federal judge ordering the production of Secret Service logs identifying visitors to the office of Vice President Dick Cheney.

Last year in the Abramoff scandal, the Bush administration, in response to three lawsuits, provided an incomplete picture of how many visits Abramoff and his lobbying team made to the White House.

The task of digging out Abramoff-White House links fell to a House committee that collected the lobbyist's billing records and e-mails. The House report found 485 lobbying contacts with presidential aides over three years, including 10 with top Bush administration aide Karl Rove.

As part of its security function of protecting the White House complex, the Secret Service uses the log information to conduct background checks on people prior to daily appointments and visits.

The memorandum of understanding is an unusual step because it deals with an unsettled area of law.

Federal courts will ultimately decide whether records identifying White House visitors and who they are going to see are under the legal control of the Secret Service or are presidential records publicly releasable solely at the discretion of the White House.

The Bush administration's agreement with the Secret Service "at a minimum will serve to postpone a final resolution of who these records belong to," said Steven Aftergood, director of the Project on Government Secrecy for the Federation of American Scientists. "This memo reflects the Bush administration's view of American government, which is that the people's business should be conducted behind closed doors."
